If you breach any of these Terms of Service, we have the right to terminate your access to the Services immediately without notice.
If you are an Expert (as defined below), these Terms of Service govern your access to and use of the Site and the Services, while the Consultancy Service Terms and Conditions (available here ) and the Appointment Terms (available here ) govern our agreement with you with respect to your provision of Appointments (as defined below) and Consultancy Service (as defined in the Consultancy Service Terms and Conditions). Certain of these Terms of Service are not relevant to Experts and do not apply to you in your role as an Expert. This is indicated in the relevant clause.
- Access to and Use of the ServiceServices Description: The Services are designed to aggregate and allow you to access general information, advice and content in relation to health, wellbeing and supplements, and, if you are an End User, to provide a booking point for selected third party nutritionists, dieticians and other health professionals (“Experts”) who wish to offer their services through the Site. If you are an Expert, the Consultancy Service Terms and Conditions (available here ) and the Appointment Terms (available here ) govern our agreement with you with respect to your provision of Appointments and Consultancy Service.
- No Reliance: You should not rely solely on information and advice available through the Site or Services. The product information on the Site or Services is sourced from each product’s labeling and advertising claims, or has been provided by Experts, and is not independently verified by Vitaminology. Always speak to your doctor before acting. You acknowledge and agree that information, advice and content made available on or through the Site and Services is provided for general information purposes only and not as a substitute for medical advice. Unless otherwise specified, all content and materials published on the Site are presented solely for your private, personal and non-commercial use. If accessing the Site or using the Services or any material or content on the Site infringes any applicable law in your jurisdiction(s), you are not authorised to access or use the Site or the Services and you must cease use immediately.
Modifications to Service: Access to the Site and Services is permitted on a temporary basis. Vitaminology reserves the right to modify or discontinue, temporarily or permanently, the Services (or any part of them) with or without notice. Appointments
- This Clause 3 does not apply to Experts. The Consultancy Service Terms and Conditions (available here ) and the Appointment Terms (available here ) govern Vitaminology’s agreement with Experts with respect to Appointments (as defined below) and the provision by Experts of Consultancy Service (as defined in the Consultancy Service Terms and Conditions).
- General. You may use the booking platform available via our Services to book an appointment with selected Experts who wish to offer their services on this Site (“Appointment”).
- Booking Process. Appointments are only available to users of the Services who ordinarily reside in the United Kingdom. Each Expert has a specific area of practice in relation to which they can accept Appointments, and they also choose their own operating hours. You can request an Appointment with an Expert on our Site by pressing the ‘Book a Consultation’ (or similar) button at the end of the checkout process. You are responsible for ensuring that your booking request is complete and accurate before submitting it. When you make an Appointment with an Expert, we act as an agent on behalf of that Expert to conclude your request from our Site and to manage your experience throughout the process. Once you have submitted a booking request and we have accepted your payment, a contract will be formed between you and the Expert with respect to the Appointment, on and subject to the terms of these Terms of Service. We will send you an email or other notification confirming your Appointment.
- Fees for Appointments. We require pre-payment of all fees to secure a booking for an Appointment with an Expert. The fees payable for your Appointment will be shown at the time you book your Appointment. We may change the fees charged for Appointments at any time, however any changes will not apply to Appointments booked before the change comes into effect. Fees include VAT.
- Payments. Payments for all Appointments are made through Stripe. Stripe is a third party payment provider, and your payment will be processed by Stripe and their terms of use will apply. Stripe’s terms will be made available to you at the time you place your booking request. Payment is made directly to Vitaminology acting as commercial agent on behalf of the Experts only. We are authorised by the Experts to accept payment on their behalf and payment of the fees of any Appointments to us will fulfil your obligation to pay the fees to the Expert in respect of the Appointment.
- How your Appointment will occur. If you book an Appointment via the Site, the Appointment will occur via our video platform, available through the Site. When booking your Appointment, you will be required to fill in the Consultation Intake Form, and then select your preferred Expert and a time slot in which you would like to attend your Appointment. We recommend that you login to the Services five to ten minutes prior to your Appointment to ensure the video and audio functionality are working properly.
- Your Responsibilities: It is your sole responsibility to include accurate information in the Consultation Intake Form and to tell the Expert about any medical or health-related conditions or special needs (including, e.g., allergies) that are or may be relevant to the services the Expert provides. If you fail to disclose such information to the relevant Expert, then to the extent permitted by law, neither we nor the Expert will be liable for any injury, loss or damage you suffer as a result of or in connection with any services, advice or information provided during the Appointment that arises out of or in connection with your failure to disclose that information. It is your responsibility to confirm the time you have selected for your Appointment is correct, and to login to the Services and the video platform to be available to speak to an Expert through our video platform at the time of the Appointment. It is also your responsibility to ensure your equipment (computer, laptop, netbook, tablet or other mobile device) meets the necessary technical specifications to enable you to access and use the Services and the video platform available through the Services during your Appointment. We will not refund any amounts paid by you for an Appointment if you cannot attend an Appointment because your equipment didn’t meet the necessary technical specifications.
- The Expert’s Role. Each Expert is solely responsible for any advice or information given to you during an Appointment. By its nature, a virtual Appointment may not always be sufficient for your needs and is unlikely to be appropriate or sufficient for emergency conditions. We recommend that you discuss any advice, information, instructions, materials or content provided by an Expert with your usual doctor. The information and advice provided by Experts during an Appointment is based on the information you have supplied to the Expert, directly, during the Appointment, or via the Services. It is your responsibility to ensure this information is correct and complete and you accept that failure to do so may affect the information and advice the Expert gives to you and may have consequences for which neither we nor the Expert are not responsible. In the event that you do not fully understand any information given during your Appointment, it is your responsibility to raise this during your Appointment with the Expert.
- Our Role: We act as a commercial agent for the Experts with whom you may book an Appointment. The Experts will provide the services during and constituting the Appointment, not us. It is the Experts’ responsibility to complete your Appointment and we simply provide the platform that helps you book and attend an Appointment with the Expert(s) of your choosing, and we take payment on their behalf. The contract for the services provided during an Appointment is directly between you and the relevant Expert, as outlined in clause 3(b) above. We make efforts to verify but cannot warrant or guarantee an Expert’s purported identity or credentials. For these reasons, we cannot and do not represent, warrant or guarantee the accuracy of the credentials or the identities of the Experts, or any particular level of expertise. You acknowledge and agree that Vitaminology is not responsible for, and will not be liable for, any loss or damage caused by your reliance on any advice, information, instructions, materials or content provided by an Expert, whether before, during or after an Appointment.
- If you have any concerns or issues with your Appointment. We are not liable for any services, advice, information or materials provided by Experts. Your sole recourse in connection with any Advice provided during an Appoitment is against the relevant Expert. If you have any issues or concerns with the services provided by an Expert, you should raise these directly with the Expert. If you are a consumer, you have legal rights in relation to services that are not performed with reasonable care and skill or are otherwise not as described. Advice about your legal rights is available from the Citizens Advice website. Nothing in these Terms of Service will affect your rights at law.
- Cancelling and Rescheduling Appointments. If you are a consumer, laws in the United Kingdom give you a right to change your mind and cancel your Appointment. If you wish to exercise this right of cancellation, you must inform us of your decision within 14 days after the date on which you book the Appointment. Please use the Cancellation Form or contact us. If your Appointment is booked for a date before the cancellation period expires, your booking is an express request to the Expert to provide the services you have requested within the cancellation period. If you decide to cancel your Appointment, you may still be charged for any services supplied until we are informed of your decision. In addition to your consumer rights, you may cancel or reschedule your Appointment and receive a full refund if you cancel up to 24 hours before the Appointment time. If you cancel an Appointment within 24 hours of the scheduled Appointment time, we will refund to you fifty percent (50%) of the fees paid for the Appointment.
- If you are late or fail to turn up. If you fail to attend your Appointment or are more than 5 minutes late to your booked Appointment, you will be deemed to have cancelled your Appointment and not be entitled to a refund of the fees paid for the Appointment.
- Our rights to cancel an Appointment. We do our best to fulfil all Appointments, but sometimes we or an Expert might need to cancel or reschedule your Appointment. We and the Expert may notify you that your Appointment needs to be cancelled or rescheduled at any time before your scheduled Appointment time. If this occurs, we will do our best to offer you a new Appointment time, and if we do so, you will have the option to accept a rescheduled Appointment, or to cancel your Appointment. You will not be charged for any Appointments cancelled by us or an Expert, or cancelled by you if we notified you that the Appointment needed to be rescheduled, and we will reimburse you for any payment already made using the same method you used to pay for your Appointment.
